Background

The Gambling and Racing Control Act 1999External link requires the Commission to develop one or more Code or Codes of Practice to cover all gambling licensees in the ACT. 

Following extensive public consultation, including specific one-on-one meetings with industry groups, the Commission has developed a Code of PracticeExternal link to cover all ACT gambling providers. 

One Code was developed due to the common principles between providers including advertising and promotions, provision of information to gamblers, training of staff, harm minimisation measures and dealing with problem gamblers. 

The Code is designed to provide minimum standards of harm minimisation across all gambling providers. 

The Code of PracticeExternal link is mandatory and has penalties for breaches. The penalties may be in the form of prosecution or by way of disciplinary action under specific regulatory legislation, such as the Gaming Machine Act 2004External link or the Casino Control Act 2006.External link



Commencement of the Code of Practice

The Code of PracticeExternal link commenced on 1 December 2002 with some provisions being delayed until 1 May 2003 to allow time for compliance. The delayed provisions include training of staff and development of procedures and information brochures or signs.

 

Training Requirements

General

The Code of Practice requires all Gambling Contact Officers as well as staff and their supervisors directly involved in providing gambling services to successfully complete approved training programs.

Training can be conducted by an outside organisation or by the licensee as an internal training program as long as the training program is approved by the Commission.

Gambling Contact Officers' Training

Regulation 11(3) of the Code of Practice states that Gambling Contact Officers (GCOs) must receive approved training. Training programs specifically targeted to GCOs must be completed by 1 May 2003.

Staff Training

Persuant to Section 1.4 of Schedule 1 of the Code of Practice all staff who are directly involved in providing gambling services and persons who supervise these staff must undergo approved training. 

Where new staff are employed and have not undertaken the appropriate training, the employer (licensee) must seek from the Commission a temporary exemption to cover the period prior to these persons undertaking the course.

An application for the exemption must include the following information:

  • details of the nominated persons;
  • evidence that definite arrangements have been made for these persons to attend the next available course;
  • the date of the course; and
  • details of the course provider.

Section 1.4 of the Code of Practice also provides that relevant staff must undergo a training course every five years.

Lottery providers and ACTTAB only need to provide training for the person in charge of each gambling facility (such as an agency outlet). The person in charge of each gambling facility is required to ensure that their staff (and staff supervisors) are appropriately trained under an approved training course.
