On-Line Gambling

The Interactive Gambling Act 1998 provides for the establishment and regulation of interactive (online) gambling products in the ACT.

However, the Commonwealth Government has legislated in the area of online gambling with the Interactive Gambling Act 2001. This Act prohibits Australian companies from offering online gaming services to Australian residents. Commonwealth laws override state and territory laws so while the Commonwealth’s Interactive Gambling Act 2001 is in effect the ACT’s Interactive Gambling Act ceases to operate. This means that the ACT does not regulate online gaming services.

The ACT does regulate online wagering services (e.g. sports bookmakers). Online sports bookmakers based in the ACT must hold an ACT Sports Bookmaking Licence. Further information on sports bookmaking in the ACT can be found under Racing and Wagering on this website.
