Licensee exclusion

When a gambling venue believes the welfare of a person or their dependant(s) is seriously at risk from the person's gambling, they must exclude the person from gambling at their venue by issuing a Notice of Exclusion from Gambling by Licensee.

A Licensee exclusion excludes the person from gambling at the licensed gambling venue, or the group of venues operating under one licence. Licensee exclusions can be for a set period of time or can be indefinite.

The licensee must give a copy of the exclusion notice to the excluded person, which will include the licensee’s reasons for imposing the exclusion.

Family and friends

Friends or family members who are concerned about a person’s gambling can talk with the Gambling Contact Officer (GCO) at a venue where that person gambles.

The GCO should consider all information available to them before deciding whether to impose a licensee exclusion (see above). Legislation does not allow family or friends to exclude another person from gambling in the ACT.

A person who disagrees with a licensee’s decision to exclude them may ask the licensee to reconsider.

They may also ask the Commission to review the exclusion.

Self-exclusion

Individuals can choose to voluntarily self-exclude from gambling. This option may be empowering for some patrons seeking to take a break from gambling. Venues have a role to play in supporting patrons through the self-exclusion process.

In the ACT, individuals can self-exclude from a selection of venues/group of venues (licensees), or all licensed gambling venues, for 6 months up to a maximum of three years.

A national self-exclusion register, BetStop, is also available that covers online and phone gambling services.

ACT Gambling Exclusion Database

The ACT’s secure exclusion database (ACTGED) is used to record all licensee and self-exclusions.

Venue staff requiring access to ACTGED will need to send a completed Database User Application Form to the Commission’s Exclusion Support Team.
